Sub: Clearance of Import / Export cargo through authorised Custom House Agents – Reg.

Kind attention
is invited to the Public Notice 190/99 dated 29.07.1999 issued by this Custom
House on the above subject.
In
spite of clear instructions in the above referred Public Notice, instances have
come to notice of the department that some Custom House Agents are still
lending their names / signatures to unauthorised persons who act as mediators
between the authorised Custom House Agents and the Importer / Exporter for
clearance of import / export cargo through Customs and other agencies thereby
evading payment of Service Tax due to the Government and leading the Government
to a loss of revenue.
The
Custom House Agents are governed by the terms and provisions set out in CHALR,
1984 and have to comply with the obligations cast upon them under regulation 14
of the regulation ibid. Therefore, the
Custom House Agents are advised that they have to exercise necessary caution
and vigil while transacting business and should act strictly within the
provisions of Customs Law and any failure on the part of the CHAs in this
regard will attract penal provisions.
The
Importers / Exporters and other trading public also are cautioned to be careful
to appoint only the Custom House Agents authorised by this Custom House for
clearance of their cargo.
