PUBLIC NOTICE NO.  51 /2002


            Government of India, Ministry of Finance, Department of Revenue, New Delhi Notification No.10/2002-Customs (NT) vide F.NO.605/74/2000-DBK dated 21.01.2002 is reproduced below for the guidance of Importers, Clearing Agents and Trading Public.

Notification No.10/2002 – Customs

            In exercise of the powers conferred by sub –section (1) of section 25 of the Customs Act, 1962(52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notifications of the Government of India in the Ministry of Finance (Department of Revenue), No.17/2001- Customs, dated the 1st March, 2001,namely: -

In the said notification,-

(B)          In the Annexure, after condition No.74, and the entries relating thereto, the following condition No. and conditions shall be inserted, namely :-

If, -

(a)

the goods are imported for Research and Development purpose .

(b)

the total value of goods imported does not exceed 1 percent of the FOB value of exports made during the preceding financial year;

(c)

the importer produces a certificate from the Joint Director General of Foreign Trade in the Ministry of Commerce of the Government of India, certifying the value of exporters made during the financial year mentioned in clause (b) above , and also the value and quantity of goods already imported under this notification during the current financial year;

(d)

the imported goods are installed in the said Research and Development Wing of the importer within 6 months form the date of importation and certificate from the Jurisdictional Assistant Commissioner of Central Excise or Deputy Commissioner of Central Excise, as the case may be , is produced before the Asstt. Commissioner of Customs or Deputy Commissioner of Customs, as the case may be, at the port of importation;

(e)

the goods imported are not transferred or sold for a period of 7 years from the date of installation";

(C)        in the list, after list 27 and the entries relating thereto, the following list and the entries shall be inserted, namely .-
