1. Importers/Exporters/Custom House Agents and all other concerned are here by informed that whenever they opt to clear and the detained/ seized goods provisionally, proforma of the bond to be furnished has been revised and is given in Annexure – I to the this public Notice.

2.Provisional release shall be accorded only if the bond is given in this prescribed proforma.

ANNEXURE – I

BOND (WITH SECURITY) TO BE ENTERED BY PERSONS SEEKING RELEASE OF GOODS SEIZED PENDING ADJUDICATION.

I/We____________________ of _____________________(here in after called the obligors(s) am/are jointly and severally bound to the President of India (hereinafter called the Government ) a sum of Rs.________(Rupees in words) to be paid to the government for which payment I/We jointly and severally bind myself/ourselves any my/our legal representatives.

Whereas a quantity of ________________-(hereinafter called the said goods) belonging to the obligor(s) are seized by the Customs Officer of Air Commissionerate/Sea Commissionerate, Chennai(hereinafter called the said Officer)for an alleged offence under the Customs Act, 192 and the rules and regulations made under the said Act.

Whereas the said Officer has required the obligor(s) to deposit as guarantee for the amount of this bond the sum of Rs _____________(Rupees in words) in cash/securities as hereinafter mentioned of total face value of Rs.________(Rupees in words) endorsed in favour of the President of India and accept on his behalf by the Commissioner/Deputy Commissioner or Assistant Commissioner of Customs, namely:-

And whereas pending adjudication of the case by the Competent officer, the said Officer has agreed to release to the obligor (S) the said goods on the obligor(s) executing the bond in the manner aforesaid.

Now the condition of this bond is that (a) if the obligor (S) and his/their legal representatives shall observe al the provisions of the customs act, 1962, so far as they relate to the seized goods

(b) if all the dues whether duty, valve, penalty or other lawful charges, which shall be demandable on the goods released to the obligor(S), be duly paid into the treasury to the satisfaction of the said officer with in 10 days of the date of demand thereof being made in the writing by the said Officer of the Customs

(c) if the said goods are produced, unless the same have totally perished in the meantime as and when directed by the said officer, this obligation shall be void. Other wise and on breach or failure in the performance of any part of this condition the same shall be in full force.

And I/We agree that the government shall be at liberty to appropriate the said deposit towards the payment of the amount of duty/valve/penalty/other lawful charges, as may be assessed/imposed by the Competent Authority in respect of the goods.

And I/We declare that this bond is ven under the orders of the Central Government for the performance of an act in which the public are interested.
