Kindly   refer to notification no.73/2001-customs dated 28th June,2001 whereby, in pursuance of review findings of Director General (Safeguards), safeguard duty was imposed on imports of phenol into India.  The notification  also  exempted imports of this item made from countries notified as developing countries under section 8B (6) of the Customs Tariff Act from the aforesaid duty.   This exemption was provided in view of the fact that the share of imports of phenol from such countries was found by DG (safeguard) to be within the prescribed de-minimis level.

         

On the basis of information that the share of imports from developing countries has, infact, exceeded this minimum level, DG (Safeguards) has initiated another review on 22.10.2001 so as to determine whether such notified developing countries are eligible for exemption from payment of safeguard duty on phenol.  Pending the receipt of final findigs, all imports of phenol from developing countries notified under section  8B made on or after 22nd October, 2001 may be assessed provisionally and a bond/security may be taken to cover the element of safeguard duty.   The assessments are required to be kept provisional in order to secure the safeguard duty which may be required to be collected in terms of the DG (Safeguards) recommendation vide its review findings .
